The Kisutu Resident Magistrate's Court, Dar es Salaam, has, once again, failed to continue hearing the criminal case of causing Grevious Harm and using abusive language against the couple Bharat Natwan (57), Sangita Bharat (54), after the defendants added another lawyer to defend them.
The couple, who are citizens of Tanzania of Indian origin, living in Mrima Street - Kisutu, Lohana building Dar es Salaam are accused of four charges that they committed on July 21, 2023 against the law.
State Attorney Faraja Ngukah claimed yesterday before Chief Resident Magistrate Aaron Lyamuya that the case was called for continuation of hearing and also one of the witnesses was ready to continue.
After Ngukah claimed this, Lawyer Mnyele explained to the Court that the defendants have added a lawyer, who is himself, and hence he requests that he be given time so that he can go through the proceedings from the beginning to the end.
As a result, the Court agreed with the request of Lawyer Gabriel Mnyele, where all parties agreed that the case should continue to be heard on two consecutive days on November 6 and 7, this year, but the other lawyer of the defendants, Edward Chuwa, demanded that it be on the sixth, the very date He has a case in the Supreme Court – again using his delaying tactics.
Lawyer Ngukah asked the court to warn the witnesses in the case so that they can come to the trial court to give their evidence. However, the witness claimed that he will apologize because it is the third time he comes to the court and he does not give evidence and he is tierd.
Judge Lyamuya adjourned the case until November 6, this year for the continuation of the prosecution's witness hearing.
It was alleged that Nathwani is accused on July 21, 2023 in the area of Mrima-Kisutu, Lohana district, within Ilala District, Dar es Salaam, illegally causing serious harm to Kiran Lalit by immersing her head in a bucket of mixed cement.
