It`s double jeopardy for two Dar residents

Two Dar es Salaam residents who are believed to be jobless were last week arraigned in Kivukoni Resident Magistrate`s Court over what can be described as a double jeopardy.
In one charge they were arraigned allegedly for causing malicious damage to properties whereas in the other they were accused of robbery with violence.
The two, Faridi Salum (22) and Hassan Shaban (22) who live at Manzese Kwa Mfunga Mbwa appeared before Resident Magistrate Nyigulie Mwaseba.
Stating the prosecution version in Court, Inspector of Police Bennet Kipasika claimed that the accused willfully and unlawfully damaged 65 empty bottles of beer, 46 chairs and broke five glasses, all valued at 650,000/-. The properties belonged to Joseph Silayo.
In the first count, it was alleged that the offence was committed at Sakai Bar, which is located at Manzese, within the city, on May 5, this year.
In the second count, the accused were charged with stealing assorted properties worth 650,000/-, which the prosecution claimed, they committed on the same date and place.
But the accused categorically denied the prosecution version shortly after the Court directed them to enter their pleas one after the other.
They were returned to remand custody after they failed to meet bail conditions.
The court had required them to present two reliable sureties each and each to sign a 200,000/- bond.
However, in what appeared to be a sharp turn of events, the accused were brought before Resident Magistrate Arnold Kileo in the same Court to answer yet another charge.
This time they were charged with robbery with violence.
Assistant Inspector of Police Subira Tossi told the court that the accused stole assorted properties worth 750,000/.
The properties belonged to Fredrick Kanga.
It was alleged that the accused resorted to the use of actual violence against the property owner before stealing the properties.
According to the prosecution, the accused hit hard the property owner in order to obtain and retain the stolen properties.
The prosecution said the offence was committed at Ubungo in Kinondoni District on April 28, this year. However, the accused pleaded not guilty to the charge and were remanded in custody after failing to meet bail conditions.
